The coverage for your friend’s vehicle is based on his car’s actual cash value (ACV). In addition, ACV is based on the vehicle’s value at the time that the accident happened, taking into consideration the present value in the market of the car. Hence with this explanation, it is the car insurance company’s obligation to cover for the repair of the vehicle basing it not on the cost of replacement but for the actual cash value.

This happened to me before. I was once involved in a car accident and the other car insurance company wanted me to sign the claim even if I am dissatisfied with the claim. So I did some research with and checked with the Wisconsin Office of the Commissioner of Insurance (OCI) and found out that I should only sign the release form if and once I am satisfied with the claim. In addition, as per Wisconsin state law, you have a total of three years after the date of the accident to file for a lawsuit or have the claimed settle.

Also, what I did to prolong the claim was I got a letter from my doctor stating on how much the cost is for my medical treatment and also for future medical bills. You can also choose to seek legal assistance if you want to.

But, if the fault is shared between the parties involved (let’s say 50-50 at fault for both parties involved) then usually what happens is that the other party’s auto insurance company will cover for the damages incurred on that person’s part. The damage incurred on your car would only be covered if he or she has uninsured motorist insurance policy.

I just wanna inform you though that Uninsured Motorist policy is not mandatory in your state. It’s just an optional car insurance coverage. However, the best advise that I could give you is not to drive without auto insurance because that is against the law. And there are penalties and fines if you violate that law.
